| dc.description | The Promise Contract of Sale, is a legal instrument that it has been used for several decades, but there has been various types of discrepancy by the misuse that it has been given to this type of contract either through ignorance or misunderstanding, take into account that the role is to promise to hold a final contract of sale between the parts. Consequently, it is of a great importance to talk about the final contract of sale, because in the Ecuadorian legislation it is governed and it has a daily use for people in their current lifes, but it should be noted and emphasize that the main function of this legal instrument is the domain transfer of the thing from the seller to the buyer. | dc.description.abstract | El contrato de promesa de compraventa, es un instrumento jurídico que se lo ha venido utilizando desde hace varias décadas, pero ha existido diversos tipos de discrepancia por el mal uso que le se lo ha dado a este tipo de contrato ya sea por desconocimiento o mala interpretación del mismo, teniendo en cuanto que la función que cumple es la de prometer celebrar un contrato definitivo de compraventa entre las partes. Consecuentemente es de gran importancia hablar del contrato de compraventa definitivo, ya que en la legislación ecuatoriana se encuentra normado y es de uso diario para las personas en su actual vivir, pero cabe destacar y recalcar que la función principal de este instrumento jurídico es el traslado del dominio de la cosa del vendedor hacia el comprador. De igual manera es de suma importancia establecer tanto diferencias como semejanzas entre estos dos tipos de contratos, para de esta manera llegar a la obtención de conclusiones. | es_ES |
