| Resumen : | La presente investigación tuvo por objeto investigar cómo la prescripción de la letra de cambio contra el aceptante incide en los efectos jurídicos sobre los derechos del girador en las sentencias dictadas en la Unidad Judicial de lo Civil con Sede en el cantón Riobamba en los años 2013, 2014 y 2015, el presente trabajo investigativo dentro del ámbito jurídico se encuentra desarrollado en cuatro capítulos de la siguiente manera: El Primer Capítulo titulado Marco Referencial, donde se pone en consideración: el Planteamiento del Problema mismo que ha dado lugar a la investigación, Formulación del Problema, seguido se encuentra determinado los Objetivos mediante los cuales se ha establecido la forma en que la prescripción de la letra de cambio contra el aceptante incide en los efectos jurídicos sobre los derechos del girador, y finalmente dentro del mismo marco referencial esta la Justificación e Importancia de la investigación. El Segundo Capítulo titulado Marco Teórico, donde se explica el tema objeto de estudio desde el punto de vista teórico, se diseña un modelo ideal que oriente teóricamente la investigación, éste capítulo contiene cuatro unidades que se refieren al ámbito teórico de la investigación, en su contenido consta de lo siguiente: La primera unidad trata acerca de: La letra de cambio, en el cual encontraremos principales conceptos de temas acordes al significado de la letra de cambio; la segunda unidad se refiere a: La prescripción, de igual forma encontramos conceptos, teorías y normas legales; la tercera unidad trata de: La prescripción de la letra de cambio contra el aceptante, el cual es la variable independiente objeto de investigación y análisis del presente trabajo; en la cuarta unidad trata de: Efectos jurídicos sobre los derechos del girador de la letra de cambio, el cual es la variable dependiente objeto de investigación y análisis del presente trabajo; y por último está la unidad quinta que se refiere a la unidad hipotética. |
| Descripción : | The purpose of this investigation was to investigate how the prescription of the bill of exchange against the acceptor affects the legal effects on the rights of the drawer in the judgments handed down in the Civil Judicial Unit with Headquarters in the canton of Riobamba in 2013, 2014 and 2015, the present investigative work within the legal field is developed in four chapters as follows: The First Chapter entitled Referential Framework, where it is put into consideration: the Approach of the Problem itself that has given rise to the investigation, Formulation of the Problem, followed is determined the Objectives by means of which has been established the way in which the prescription of the bill of exchange against the acceptor affects the legal effects on the rights of the drawer, and finally within the same frame of reference is the Justification and Importance of the investigation. The Second Chapter entitled Theoretical Framework, where the subject matter of the study is explained from the theoretical point of view, an ideal model is designed to theoretically guide the investigation, this chapter contains four units that refer to the theoretical scope of the research, in its Content consists of the following: The first unit deals with: The bill of exchange, in which we will find main concepts of topics according to the meaning of the bill of exchange; the second unit refers to: The prescription, likewise we find concepts, theories and legal norms; the third unit deals with: The prescription of the bill of exchange against the acceptor, which is the independent variable object of research and analysis of the present work; in the fourth unit it deals with: Legal effects on the rights of the drawer of the bill of exchange, which is the dependent variable object of investigation and analysis of the present work; and finally there is the fifth unit that refers to the hypothetical unit. In the Third Chapter called Methodological Framework, the verification of the hypothesis is carried out, through the interpretation of the data obtained in the investigation. The methods were used: inductive, analytical and descriptive, the techniques used were the interview and the survey. In the Fourth Chapter the conclusions and recommendations are put to consideration as a consequence of the investigation. |
