| Resumen : | El presente trabajo investigativo que tiene como objetivo determinar cómo la valoración de la prueba incide jurídicamente en las sentencias de prescripción adquisitiva extraordinaria de dominio, se lo ha dividido en 4 capítulos, sus contenidos se subdividen en unidades, temas y subtemas que se asocian con la temática a investigarse. El primer capítulo denominado Marco Referencial, es donde se da a conocer los antecedentes de la investigación y está contenido por el planteamiento del problema, formulación del problema, objetivo general, objetivos específicos y finalmente se plantea la justificación e importancia del trabajo investigativo. El segundo capítulo, denominado Marco Teórico, contiene antecedentes de la investigación, así como la fundamentación filosófica y teórica. El tercer capítulo, denominado Marco Metodológico, abarca el método investigativo, diseño de investigación, población y muestra, operacionalización de las variables, análisis e interpretación de resultados y verificación de la hipótesis. En síntesis se ha procurado que desde el punto de vista metodológico exista una coherente relación entre los contenidos y el tema a investigar, para finalmente, realizar una validación por medio de la entrevista y encuestas. En el cuarto capítulo, se establecen conclusiones y recomendaciones que se han realizado acorde a los resultados de la investigación efectuada. |
| Descripción : | The present investigative work which is to determine how the assessment of the has a legal impact on the test has a legal impact of the jugments of extraordinary acquisition of dominance, has been divided into four chapters, its contents are subdivided into units, themes and subtopics that are associated with the subject to be investigated. The first chapter, denominated the Referential Framework, is where the background of the research is presented and is contained in the problem statement, problem formulation, general objective, specific objectives and finally the justification and importance of the research work. The second chapter, called Theoretical Framework, contains background of the investigation, as well as the philosophical and theoretical foundation. The third chapter, called the Methodological Framework, covers the research method, research design, population and sample, operationalization of variables, analysis and interpretation of results and verification of the hypothesis. In adition it has been tried that from the methodological point of view there is a coherent relation between the contents and the subject to investigate, finally, to carry out a validation through the interview and surveys. In the fourth chapter, conclusions and recommendations are made according to the results of the research carried out. |
