| dc.description | This research is structured by five chapters, which content includes units, themes and sub-themes according to the topic related to the investigative work. Chapter I, REFERENCE FRAMEWORK, contains an outline of the problem the formulation of the problem, general and specific objectives, as well justification and importance; The general objective of this research is to determine through a legal study, as the principle of impartiality affects the judgments issued by the judges who issued a self-appeal in transit. In relation to the specific objectives it is highlighted: Hold out a study of the principle of impartiality. Chapter II, THEORETICAL FRAMEWORK, contains antecedents of the investigation, theoretical foundation, definitions and characteristics of the principle of impartiality, procedure to follow in Transit and the effects of the principle of impartiality in the judgments issued by the same judges who emit the self-appeal judgment; Developing the theme of the present investigation through a doctrinal, legal and critical study emphasizing the constitutional principle that is being assured. Chapter III, METHODOLOGY, includes the investigative method, research design, population and sample, operationalization of the variables; Thus verifying the development of methodological research or field research, which has been carried out prior investigation to the lawyers in free exercise and Judges of the Criminal Judicial Unit based in the canton Riobamba; The interpretation and discussion of the results have also been carried out in order to verify the hypothesis proposed at the beginning of the investigative work. Chapter IV, ADMINISTRATIVE FRAMEWORK, holds in the resources and costs of the research that will be used for the execution of the research. | dc.description.abstract | La presente investigación se encuentra estructurada por cinco capítulos, cuyo contenido comprende unidades, temas y subtemas acordes a la temática relacionada con el trabajo investigativo. EL CAPÍTULO I, MARCO REFERENCIAL, contiene planteamiento del problema, formulación del problema, objetivo general, objetivos específicos y justificación e importancia; en particular se establece como objetivo general del trabajo investigativo determinar a través de un estudio jurídico, como el principio de imparcialidad incide en las sentencias emitidas por los jueces que dictaron auto llamamiento a juicio en materia de tránsito. Con relación a los objetivos específicos se resalta: Efectuar un estudio del principio de imparcialidad. El CAPÍTULO II, MARCO TEÓRICO, contiene antecedentes de la investigativo, fundamentación teórica, definiciones y características del principio de imparcialidad, procedimiento a seguir en Tránsito y los efectos del principio de imparcialidad en las sentencias emitidas por los mismos jueces que dictaron el auto llamamiento a juicio; desarrollando la temática de la presente investigación a través de un estudio doctrinario, jurídico y crítico haciendo énfasis en el principio constitucional que se está garantizando. EL CAPÍTULO III, METODOLOGÍA, contiene el método investigativo, diseño de investigación, población y muestra, operacionalización de las variables; así verificando el desarrollo de la investigación metodológica o investigación de campo, la misma que se ha llevado a cabo previa investigación a los Abogados en libre ejercicio del cantón Riobamba y Jueces y Juezas de la Unidad Judicial Penal con sede en el cantón Riobamba; también se ha realizado la interpretación y discusión de los resultados para poder verificar la hipótesis planteada al inicio del trabajo investigativo. | es_ES |
