| Resumen : | La presente investigación permite conocer cómo se desarrolla la problemática del maltrato infantil y la aplicación de las medidas de protección en el sistema jurídico ecuatoriano en beneficio de los niños y niñas que viven en situación de riesgo, sin embargo la normativa existente resulta insuficiente para enfrentar las diversas circunstancias que se presentan en la praxis. Este trabajo esta diseñado para facilitar el conocimiento de las leyes que regulan y sancionan el maltrato infantil sus avances e inconsistencias en el ordenamiento jurídico, sobre todo para informar como influye la aplicación de las medidas de protección en los índices de maltrato infantil. La presente tesis está compuesta por cuatro capítulos en primer lugar está el Marco Referencial en el que consta el planteamiento del problema, su formulación y los objetivos. El segundo capítulo es el Marco Teórico, en el que se constituye la Fundamentación teórica distribuida en cuatro unidades, la hipótesis y la Operacionalización de las variables. El tercer capítulo es el Marco Metodológico en el que se fundamenta de manera científica la investigación utilizando los diferentes métodos y técnicas de interpretación de resultados para llegar a la comprobación de la hipótesis. En el cuarto capítulo se encuentran las conclusiones y recomendaciones a las que se ha podido llegar después de conocer la realidad de la aplicación de las medidas de protección y su influencia en los índices de maltrato infantil en los procesos tramitados en el juzgado primero de la niñez y adolescencia del cantón Riobamba, durante el periodo del 2010. |
| Descripción : | The present investigation allows to know like it is developed the problem of the infantile abuse and the application of the protection measures in the Ecuadorian juridical system in the children's benefit and girls that live in situation of risk, however the existent regulatory scheme is insufficient to face the diverse circumstances that are presented in the practice. This work this designed to facilitate the knowledge of the laws that you/they regulate and they sanction the infantile abuse their advances and inconsistencies in the juridical classification, mainly to inform like it influences the application of the protection measures in the indexes of infantile abuse. The present thesis this compound one for four chapters in the first place this the referential in which consists the position of the problem, their formulation and the objectives. The second I surrender he/she is the Theoretical Marco, in the one that the theoretical Foundation is constituted distributed in four units, the hypothesis and the operationalization of the variables. The third surrender he/she is the Methodological Marco in which is based in a scientific way the investigation using the different methods and technical of interpretation of results to arrive to the confirmation of the hypothesis. In the room I surrender they are the summations and recommendations to those that has been able to arrive after knowing the reality of the application of the protection measures and their influence in the indexes of infantile abuse in the processes processed in the first tribunal of the childhood and adolescence of the canton Riobamba, during the period of the 2010 |
