| Resumen : | La valoración de la prueba es una operación mental en virtud de la cual el juzgador determina la fuerza de convicción, en conjunto, de los elementos de prueba aportados por las partes, para inferir si son ciertas o no las afirmaciones hechas tanto por el actor como por el demandado, en efecto la valoración de la prueba es la actividad de razonamiento del juez, en el momento de tomar la decisión definitiva, bajo esta concepción la presente investigación titulada: LA VALORACIÓN DE LA PRUEBA TESTIMONIAL EN LOS PROCESOS DE VIOLENCIA INTRAFAMILIAR Y SU INFLUENCIA EN LAS RESOLUCIONES DICTADAS POR LOS JUECES DE LA UNIDAD JUDICIAL ESPECIALIZADA EN VIOLENCIA CONTRA LA MUJER Y LA FAMILIA DEL CANTÓN RIOBAMBA, DURANTE EL PERIODO JULIO A DICIEMBRE DEL 2013; para alcanzar el propósito de la investigación se realizó un estudio jurídico, doctrinario y crítico sobre la violencia intrafamiliar y la prueba testimonial, esto permitió determinar la relevancia jurídica de la prueba testimonial en los procesos de violencia contra la mujer y los miembros del núcleo familiar; para fundamentar y comprobar la hipótesis de investigación se aplicó una encuesta a los a Jueces de la Unidad Judicial Especializada en Violencia Contra la Mujer y la Familia del cantón Riobamba y a los abogados que patrocinaron procesos de violencia intrafamiliar durante el periodo julio a diciembre del 2013, los resultados permitieron describir que, la valoración de la prueba testimonial en los procesos de violencia intrafamiliar influye significantemente en las resoluciones dictadas por los Jueces de la Unidad Judicial Especializada en Violencia Contra la Mujer y la Familia del cantón Riobamba, durante el periodo julio a diciembre del 2013. |
| Descripción : | The standard of proof is a mental operation by which the judge determines the strength of conviction, overall of the evidence presented to infer whether or not the statements made by both the actor and by the defendant are true, in fact the standard of proof is the activity of reasoning of the judge, at the time of the final decision under this conception the present research entitled: THE ASSESSMENT OF THE TESTIMONY IN THE PROCESS OF DOMESTIC VIOLENCE AND INFLUENCE ON RESOLUTIONS PASSED BY THE JUDGES OF THE COURT UNIT, SPECIALIZED IN VIOLENCE AGAINST WOMEN AND FAMILY, RIOBAMBA CANTON IN THE PERIOD OF JULY TO DECEMBER 2013; in order to achieve the purpose of the investigation, a legal, doctrinal and critical study on domestic violence and the testimony took place, this allowed to determine the legal significance of the testimony in the processes of violence against women and household members; to support and verify the research hypothesis, a survey was applied to the Judges of the Judicial Unit Specializing in Violence against Women and the Family of the canton Riobamba and lawyers who sponsored processes of domestic violence during the period of July to December 2013, which described that the results allowed the assessment of the testimony in the processes of family violence significantly influence on decisions of the Judges of the Judicial Unit Specializing in Violence against Women and the Family of the canton Riobamba, during the period of July to December 2013. |
